Texas man sues California doctor over medication abortion

Synopsis

A California doctor is being sued by a man in Texas for allegedly mailing abortion medication to his girlfriend, reports Courthouse News’ Cameron Thompson. The doctor, a San Francisco Bay Area physician with 30 years of experience, is practicing under California’s shield law, which protects providers from prosecution for out-of-state abortions. Now, a state with an abortion ban is testing how far those bans can reach. 

The Texas man’s lawsuit claims to represent “all current and future fathers of unborn children in the United States,” arguing embryos have legal rights under the Comstock Act, a dormant 1800s law that would ban abortion on the federal level.
